1) What step to be taken if one party take advantage of settlement arrived at mediation by HC & has refused to comply the order / direction of Court ? n2) Matter still pending for Final disposal in HC , what step can be taken ?

Dear Questionnaire Under such circumstances you can fight your case on merit, apart from this mediation order is binding on both parties subject to acceptance of terms. We suggest to provide the document to Advocate for legal remedy or feel free to call.

As you didn't share the details about the type of case for which the mediation was done. If you have any proof with the non compliance of the settlement happened through mediation against the opposite party, then you can submit the details in High court with this regard on the next date in court.
