Procedures and conditions for granting approval to leave the country

25-Jan-2023 (In Criminal Law)
Bail granted by District Sessions Court with conditions of 438. i.e. Before leaving India, person must get permission form the Court. The application is filed in the same court but its taking more time than expected. I have made plans to go to US for a family emergency there. What are the implications if I leave India before approval is granted on application of permission to leave India.

If you violate the conditions of your bail, the implications can be several. Your bail can be cancelled. Proceedings to declare you a PO can be initiated. Your passport can be revoked by the passport authorities. Furthermore lookout notices can be issued against you at the airports.
Best possible way is to file a CM in the earlier application showing your urgency. Move to High Court if Sessions dismisses it.
