Procedure to reinstate bail bond in Gurgaon

A friend of mine could not be present in court on one of her dates as the lawyer forgot to file a written exemption...so a NBW has been issued and order read she should be arrested and brought before court.I have 2 questions why was no bailable warrant issued first and secondly can the same surety be used again.with the same bond given earlier.

To secure attendance of accused the Court issued non bailable warrant and the already stand as surety can't be stand as surety your friend can know the Door of Court along with new surety and present a application for bail describe the detail of presence

Once an accused put up his/her appearance before the court and subsequently absents without a valid reason and without submitting exemption application, the courts as matter of routine issue Non-Bailable warrants against the accused and notice to the surety after confiscating the bail and surety bond. As the earlier bail/surety bonds stand cancelled, so now fresh surety would be required at the time of seeking bail.

There is no requirement of bailable warrant, since your friend has effectively jumped the bail, on account of non appearance, and the lawyer not filing an application for exemption. Under the present circumstances, your friend can surrender before the court, and seek fresh bail by furnishing fresh bail bonds. Same surety can't stand as surety to give bail. The surety amount given earlier stands forfeited to state of haryana. Usually none cares to recover the said amount from the surety.
