Procedure to know about the case trials after filing of Charge sheet

07-Jul-2023 (In Criminal Law)
I filed an FIR in 2015 against a neighbour for destruction of property. The police very unwillingly filed the FIR. Now, after 2 years, I was intimated that charge sheet has been filed. I am not sure what has been sent with the charge sheet to support the case. I suspect that the accused is behind this action so that he can get the case dismissed so he can prove that I had filed a false case against him. As a complainant, how can I be involved in this case since it is now between the accused and the state? I have no doubts that the police have watered down the case and have tampered with the evidence that I had originally given them.

You may watch the proceedings for a while and you can go through the charge sheet, witness list etc and if you are not happy you can request the court that either you will prosecute or appoint a pleader. This is provided under section 302 of Crpc and you may go through the latest decision:
he Court also referred to J.K. International v. State (Govt. of NCT of Delhi), (2001) 3 SCC 462, where it was held that that a private person can be permitted to conduct the prosecution in the Magistrate’s Court and can engage a counsel to do the needful on his behalf. Also, when permission is sought to conduct the prosecution by a private person, it is open to the court to consider his request and the Court has to form an opinion that cause of justice would be best subserved and it is better to grant such permission and it would generally grant such permission. [Dhariwal Industries Ltd. v. Kishore Wadhwani, 2016 SCC OnLine SC 935, decided on 06.09.2016]
