Procedure to file for Quashing of FIR in case of no settlement
22-Nov-2023 (In Criminal Law)
I work in a bank in cash Dept and one customer lodged private complaint in the court against bank officials and it was taken up by crime branch for misuse of funds in their account. When we visited crime branch for Inquiry they threatened me to include in the case if we don't compromise for settlement. Accordingly then branch manager entered into compromise (not me)for 11 lacs out of which he paid 7lacs till now. In between when he has not paid crime branch threatened me over phone. So I took advocate he spoke with public prosecutor and said me they included as second person (he said orally not seen any CD files)so he is suggesting to go for quashing in high court. Now my question is whether I should wait till he settles fully (not sure when) or should I go for quashing. Will it be successful
Sir, you may go for quashing of FIR against you / discharge you from the complaint upon establishing that you are in no way connected with the swindling of funds. Let the manager go ahead with settlement, but in order to safeguard yourself you shall proceed with the quash/discharge/dispense with as the case may be before the High Court. Since the partial information you provided do not help me in providing elaborate guidance I request you to fix an appointment for better advice.
