Procedure to file cheating case against husband

I was deserted by my husband and in-laws since 2015.my husband and myself lived only for 10days.He left to USA promising me he will send visa docs.My dowry amount is also with my husband.no representation on behalf of my husband for maintenance case also.my father-in-law took GPA for dissolution of marriage in Hyderabad court and court accepted and case is under trail.can I keep a cheating case against my husband ,in-laws in policestation.i heard they will send it to court if court accepts they will register the case.may I know the procedure ?can I keep section 417?
