Procedure in case restaurant owner is penalized for using the gov land

Sir I am running restaurant located on state Highway within municipal committee limits.some months ago Forest department has filed case against me that you are using our Forest land which lies between road and my restaurant illegally.so they demanded 149000/- rs. by saying this that you are using our land by putting soil in our area.my frontage is approx.120 feet.but to do sir.
if your construction is approved from the concerned municipal committee and construction of the restaurant according to the site plan which was supplied by you to the municipal committee, then the Forest department has got no right to claim any charges from you and if the department forced to you for making the payment then the approach the civil court.
