Procedure for Appeal to CCB Team due to No response
30-Jun-2025 (In Criminal Law)
Hi Sir/Madam,
We have received court order to get the blocked funds from bank involved account, but CCB saying there is now funds stated by Bank.. Request your help, how blocked funds has been not available in respective fraud account
Hi, as per your note, if a court order was already obtained for recovery of blocked funds and the bank now claims funds are not available, you may seek an explanation via a contempt petition or file a compliance report request. If the CCB or bank allowed withdrawal of funds after the court’s freeze order, it amounts to a serious violation, and you can file a petition under Section 482 CrPC for enforcement. Additionally, you may:
1. Request a status report from the CCB about the disbursal or movement of funds.
2. File an RTI (if applicable) with the bank or CCB for transaction history.
3. Move an urgent application before the same court seeking an explanation and accountability from the bank officials.
consider filing a petition with the court that issued the order, highlighting the bank's non-compliance. Attach any correspondence with the bank as evidence. You may also need to involve the Reserve Bank of India (RBI) or the Central Consumer Protection Authority (CCPA) if it involves consumer rights or banking irregularities, requesting an investigation into the matter.
You must immediately file a petition before the same court that issued the order, seeking a direction to the concerned bank and CCB to submit a detailed status report on the fund movement, account balance at the time of blocking, and current status. Simultaneously, you can issue a legal notice to the bank demanding explanation for the unavailability of funds despite the freezing order.
If there is suspected collusion or negligence, initiate contempt proceedings or criminal complaint under appropriate provisions for disobedience of court orders and misappropriation. You may also file an RTI (if applicable) to obtain communication records between the bank and CCB regarding the blocked account.
