Procedure against advocate for misprofessional conduct

04-Sep-2025 (In Criminal Law)
I filed a complaint against advocate in Bar Council of Uttar Pradesh for misprofessional conduct and defaming me by sending a false notice by using illegal words which are not professional under the law provision. It's more than 2 months but I didn't get any notice for hearing or action taken on my complaint. I also paid the fees through the DD mode. And there is no active mobile number on website through which I can contact! What is the next procedure for it? Kindly provide any mobile number.

Its a deeply concerning situation where an advocate is subjecting you to such unprofessional situation. you could draft a proper complaint and send it to the Secretary of the BCUP, annexing copies of the concerned documents. send it by registered post, and include a self addressed and stamped envelope for ensuring quick response. if the State Bar Council fails to initiate a disciplinary enquiry against the advocate in question, then you can further escalate the matter to the Bar Council of India through Secretary. take the same steps and hopefully you will find a quick resolution.

If no action has been taken on your complaint even after two months, you should: Send a written reminder to the Secretary, Bar Council of Uttar Pradesh with a copy of your complaint and DD receipt. Escalate to the Bar Council of India if the State Bar Council remains inactive. File an RTI to obtain the official status of your complaint. If still no response, approach the Allahabad High Court under Article 226 for directions. I can assist in drafting the reminder, filing RTI, escalating to BCI, and if required, moving the High Court – all of which can be handled online from home. Adv. Have you received any acknowledgement or notice for hearing ? First try to formally contact the bar council by submitting written request or something Or visit the council office in person can be effective Or file a RTI to the bar council asking for status and if still fail then you can approach high court under writ jurisdiction
