Procedure after first bail application gets rejected by session court
15-Nov-2023 (In Criminal Law)
What can be done if first bail is rejected by session court. Ips 379b/2 an jail custudy is 1 month
There is no problem wait for filing the challan. when the prosecution has presented the challan, then gone through the challan, what is the role of such person, whose bail was dismissed. then after collecting the all documents file the bail before the Hon'ble High Court of Punjab and Haryana at Chandigarh.
Dear you can approach to High court for regular bail, but before moving to high court, it is important to see the contents of your FIR, what are the aligations , whether the custody in sufficient as per the FIR contents.
You should approach to high court by filing second bail application and it may depend up to hc, in Punjab and haryana high court it will take minimum 30 days.. You may also file second bail application in sessions court but moving application in high court will be much effective
dear questioner, your information is not enough to provide the proper answer to your query. however, if the first application is rejected you can go for second regular bail application but you have to wait for a month or till the challan is presented. if the challan got presented you can apply a bail application u/s 167(2) crpc.
Then file a bail application before high court one cannot move second bail application unless there is no new ground to the bail application it's the sole criteria with the honble judge to grant bail or not but also depends upon the seriousness of the allegations
