agar koi minor ladki ka haanth bina kisi intention k pakda ho toh koi dhara as such nahi lagti. kyunki intention prove nahi hota. but agar galat irade se haath pakda ho toh POCSO ACT k antargat section 8 aur section 354A IPC LAG sakta hai. dep nding on the nature of action and intention of the accused.

many time police register a posco case under section 10,11,12, but court frame charge normally 354A (1) (i) IPC is bailable . in many time in trail court judgement accquitttal in posco case but sentence under 354 A
