Even if an FIR is lodged, it can be quashed under Section 482 CrPC for abuse of process of law, as such allegations would be purely civil or personal in nature, not criminal. Digital chat records, timelines, and lack of physical proximity will strongly support your defence.

Based on the facts provided, it is clear that no physical meeting or relationship ever took place between the parties and that all communication was limited to Instagram chats. Therefore, any complaint or FIR under Section 69 of the Bharatiya Nyaya Sanhita (earlier Section 376 IPC) would not be legally maintainable. A mere promise of marriage made on social media, without any physical contact or sexual relationship, does not constitute the offence of rape or any sexual offence under Indian law. If any such FIR is lodged, it would amount to a misuse of law and can be challenged before the Hon’ble High Court for quashing at the initial stage itself, as it does not disclose any cognizable offence.

Anyone can try to approach the police and can file a complaint, but that does not mean it will become a case against you. From your facts, there was only Instagram chatting, no meeting, no physical relation, no sexual demand, and you blocked her long back. Such facts do not make out any serious offence. Even if a false FIR is filed, it can be handled easily through legal remedies.

Hi there, the answer to your question is not that simple. As a citizen's right the girl can definitely file a complaint against you u/s 69 Bnss but since you have promised marriage on Instagram that will substantiate her claims to an extent. However, it's advisable to contact me and provide requisite details in person considering the sensitive nature of your issue.
