Police closed the case, closure report filed

04-Aug-2023 (In Criminal Law)
Hello advocates, Police was investigating a complaint by one family against one of my known persons. Some money was taken and that is now returned. Now both parties have settled their dispute outside the court before the beginning of trial, charge-sheet was not filed by police till now and now police has filed the closure report. Is this the end of this issue? Can we forget this thing and move on in life?nThank you.

Hi In case a closure report has been filed - it basically means that after investigating the matter - no offence was made out. Closure report means that the police has closed investigations now. However you still need a final judgment wherein the court will acquit the accused. Regards Adv. Abhinav Sharma

Yes…if the police officials have filed their closure report then it will be the end of the case. After that the magistrate if satisfied with the closure report can record statements of both the parties and then both the parties are free to enjoy their life. We have to see that what are the sections of FIR… if FIR was lodged under compoundable offences then it’s okie .. but if offense itself is not compoundable then this closure report stands zero because for non-compoundable offence the only thing left is the quashing at the Hon’ble High Court ..please be in touch thank you ..
