Pocso 7/8 case registered on me. Already got bail from session court

Pocso 7/8 case registered on me.I am not here to tell whether I m guilty or not as I leave it to your experience on pocso matter where things are always consenual and in my case dating app leads me to pocso as I m unaware of age. My question is the victim father is taking 2 lakh for settlement and their lawyer saying on the basis of father's statement everything will be done and victim will not come for chief examination. I m wondering is it really possible?

Dear As far as my knowledge and experience goes, it isn't “always” consensual when it comes to POCSO. However, your lawyer is correct that his father's testimony will be paramount in deciding your case and settlement will not be a ground for your acquittal. Note that this is not a compoundable offence where you go for a settlement and get free from the clutches of justice. You want a proper solution, call me.

Father cannot do any thing since it's posco matter . As per law there is no settlement in POSCO cases . Out of court settlement can be done verbally but it all depends upon statement of victim before court

Hi querist, that depends on the age of the victim and her mental ability to understand the consequences. Victims father does not have much saying in this as section 19 only gives power to report an offense by the non victim and protection to him or her thereof. however, the High courts under the quashing cases usually don't consider the statements of the father of the victim even if they come in support and further may order compensation apart from the settlement amount. it is advisable to consider all this. if facts go by, move for quashing on merits of the case, if no case is made out or look for discharge options.
