Under Section 173(8) of the Criminal Procedure Code (CrPC), the police are empowered to conduct further investigation even after the charge sheet has been filed if new evidence or facts come to light. Courts have allowed further investigations under this section in several judgments, including cases like Vinubhai Haribhai Malaviya vs State of Gujarat (2019), where the Supreme Court held that both the Magistrate and the police have the power to order further investigation at any stage before the commencement of the trial. You can request the court for further investigation if there are omissions in the charge sheet, such as missing accused names or insufficient sections applied, to ensure a complete and thorough investigation. It would be best to present relevant facts to the court for this purpose.
