Physical violence during my stay at Hotel in Chandigarh, Punjab at boo

23-Feb-2023 (In Criminal Law)
Hi I booked a hotel (OYO 8278 Supremo having booking ID 8968673136) on Sunday (20/02/2022) and logged at 09:00 PM and logged out the other day. At the time of logout the hotel staff asked for my bill and snatched my phone as I rated the hotel 1 star on OYO. After an argument, 4 of the hotel staff attacked me brutally. I called the police when I had a hold on my phone and PCR came. The police personnel told me to let this go and you will have to come again if you file a complaint. I was so scared that I left for home and raised the issue with OYO. OYO informed me that they are looking into it and will pull out the CCTV footage. It has been 2 days since I heard from OYO and they are not responding to my mail as well as my tweets. Is there any way that those perpetrators can be punished?

Yes, certainly. In the concerned matter, you have two legal remedies available. First, if you have been physically or mentally assaulted then can file a police complaint or a FIR against the individuals who have committed the assault under various sections of the Indian Penal Code. Once, the FIR has been filed Police will conduct an investigation and further, file a charge sheet in court. If it is established that the assault has been committed then the accused will be punished with imprisonment or with a fine. Second, you can a consumer complaint against the OYO Hotel in from of District Consumer Commission. This complaint will be filed for deficiency in services. If the Consumer Commission provides a judgment in our favor then we will be awarded with a compensation amount for the mental agony and damages caused by the employees of OYO. Personally, I would suggest that you should go forward with the Consumer Complaint.
