physical assault by neighbours in Najafgarh, Delhi

16-May-2023 (In Criminal Law)
Hi Sir/Madam, My mother in law and brother in law were assaulted physically by neighbours in Najafgarh,Delhi on 7th May 2020 ( 5:45pm). We have video evidence of this crime from one of the neighbours CCTV camera, police has recorded the complaint in general diary. However, no action has been taken against the perpetrators . My mother in law is 60 years old lady and she has health issues from long time. Me and my wife are in Bangalore and there is no body to help her at this moment of crisis. She and her son feels helpless in front of police as they are not interested to take action and the neighbours still continue to be a threat. I want to understand what legal options do we have to pursue this case further and bring culprits to justice. Request you to provide legal guidance on this matter. My mother in law's phone number is 9911320169, she can be contacted in case any further information is required. Regards, Ashish

When an FIR is not registered by the police you can complaint to the DCP or superior officer of the police and later file an application before the magistrate under sec 156(3) crpc to order the police to register an FIR. However the situation currently is very tricky due to the lockdown, i would advice you to use online modes to complaint to the senior officers of Delhi police. Kindly keep the cctv footage preserved.

hello as you are saying tht you are the son in law of the concern family and you lives in banglore. as the incident is been described by you is seem to he very much ofended as well as very much serious in nature as well. in this condition i need to see the conplaint which your mother in law have given to the police on which simple dairy entry has been made and no FIR is been registered as of now. in my openion beeb the senior citizen she is having an option to move to high court directly foe the action against the culprits of law as police is trying to help them.
