Physical Assault and injury in ear

07-Mar-2025 (In Criminal Law)
I was beat up by three people who were assaulting other two boys in their early teens as I was filming the incident. The video which I shot is not of good quality (as it was night time) to identify the assaulters. A person who was a bar owner intervened and saved me from further assault and I left the spot. I stay in a paying guest accomodation in a society, and I fear if I approach police, my houseowner may quickly tell me to vacate PG. So how do I take action on the people who assaulted me??

You can file a police complaint under BNSS provisions and sections for assault and criminal intimidation. Approach the police a lawyer to avoid issues with your landlord. The bar owner can be a substantial witness.

MYSELF SUGGEST YOU TO REGISTER FIR WITHOUT HINDRANCE AS HOUSE OWNER WILL BE LEGALLY BOUND TO HOLD THE DECISION AND APPOINT AN ADVOCATE IF FIR IS REFUSED BY POLICE STATION OFFICER. THANK YOU. ADVOCATE SUBODH INGOLE.

Dear client based on your question, it is suggested that you need to talk with your P. G head and for legal action you need to file the complaint to the police station. You can file a complaint with the help of an advocate. For further guidance feel free to contact us.

You should approach the police for filing NC or FIR (depending on the nature of assault and other facts). You can also file suit for tort and damages but you have no idea who those people were. You only have an option of first approaching police and then may be a civil remedy.

You have the right to take legal action against those who assaulted you, regardless of your accommodation situation. Assault is a criminal offense under Sections 323, 325, and 506 of the Indian Penal Code (IPC). Since you were attacked while trying to document a crime, you may also have a case under Section 351 (criminal force and assault). Even if your video is not clear, you can still file an FIR (First Information Report) with the police. Mention the presence of the bar owner as a witness, and provide details about the incident, including date, time, and location. The police can investigate further, possibly obtaining CCTV footage from nearby places. If you fear eviction from your paying guest accommodation, you can report the incident anonymously through an online police complaint or a written application submitted via a lawyer. Your safety is a priority, and legal action can deter future assaults. Additionally, if you face any pressure to vacate your PG without valid reason, you may have rights under tenancy laws and should seek legal counsel to protect yourself from unlawful eviction.
