Phone conversation was recorded and leaked without consent

My father has been falsely accused by our landlord's daughter-in-law, who is spreading a fake story about a relationship between him and the landlord. She also recorded their phone call without consent, even though there was nothing inappropriate in it. These false claims have defamed our family and caused emotional distress. We seek legal action for defamation and privacy violation.

You can file a private complaint accompanied by a legal notice against him with evidences both oral and documentary. You can also seek civil action against him before the jurisdictional munsiff. It will be better to send lawyer notice prior to the litigations

A defamation case can be civil or criminal. The main this to prove in a defamation case is that you need to prove that there was an injury /insult caused to you because of the act of the accused. You may also need to produce the witnessess and proof to substantiate that.. Her act is an offense as per BNS and IT act. She may get punishment upto 2 years if proved and also need to pay monetary compensation. May contact me for further details

If your father is being falsely accused and someone recorded his call without consent, you can take legal action for defamation and violation of privacy. It's a punishable offence under the new Bharatiya Nyaya Sanhita and IT laws. You can send a legal notice and also file a police complaint. Keep all evidence safe-it will help if things go to court.
