Pendancy of Discharge Application since 2019

Hi, I have a pending discharge application at Borivali Magistrate Courts, Mumbai The discharge application is pending since 2019. On each hearing date either the judge is on leave or he is busy with special drive bail and remand work. Can I file a petition to Expediate the proceedings before the HC u/s 482 Crpc Any best alternative to get relief from criminal case?

It is not possible that your discharge application is pending since 4 years for this reason. Discharge applications are disposed off maximum within one year if followed up by the advocate properly. You can file 482 petition, but HC judges generally do not hear quashing petition when discharge application is already pending. My advice to you is to follow up the discharge application with your current advocate or change him.
