PCC after settlement of the dispute

25-Apr-2023 (In Criminal Law)
Hello, there is a cross FIR filled with me along with the chargesheet and opposite party u/s 506,509,504,34 about three years ago. But now both parties wants to settle the case,Can you tell me that how can me compromise or settle the case? Should I approach concerned magistrate or High court to quash the case. And also it's important that i want to go abroad on work visa and I do require PCC with preferably no adverse remarks..So After settlement of criminal case is there any chance police will not put it on my PCC? Thanks in advance!!

you need to discuss the issue in detail with someone as the case mentioned by you seems to be pending before a magistrate and the same needs to be settled. whether or not a case can be settled depends solely on whether it is compoundable or not

all sections that you have been charged for are compoundable offences meaning that the victim can compromise the case however in the above case you will need to ask the party complainant to settle or comprise the matter and you will need to seek courts permission to do so. as section 320 of crpc. the criminal case will still show up in pcc but you can defend it by showing the criminal court order.
