29-Sep-2024 (In Criminal Law)
I was working in a bar and restaurant as an artist in orchestra group one day there was raid happened by police and they took us in custody after that they put criminal case on me and my colleagues in IPC section 294 , 34
And another case is happened in another place in IPC section 294 , 114
Section 294 of the Indian Penal Code deals with obscene acts and songs in public places, and it is often invoked in cases involving performances in bars and similar venues. Section 34 refers to acts done by several persons with a common intention, meaning the case against you and your colleagues is likely based on the idea that you acted together. Section 114 is used when someone is present during the commission of an offense, with the intent to support or promote it.
For Section 294, the prosecution must prove that the act was obscene and was performed in a public place, causing annoyance to others. If your performance was purely artistic and within the guidelines of the venue, this could be used in your defense. You could argue that the performance was a part of your job, without any intent to cause offense or annoyance.
