Orders for Disconnection of electricity given by MSEDCL on fraud docs
08-Apr-2023 (In Criminal Law)
In a criminal matter of cheating & forgery, the Magistrate while framing charges remarked in his Order that the accused person has submitted false & fraudulent documents with MSEB & the State Excise Dept to obtain electric connections to 14 shops belonging to the complainant’s father and has obtained a Beer Bar License in his name to run a Beer Bar & Restaurant and therefore there is sufficient ground to frame a charge against the accused for offenses punishable under section 465 and 471 of the IPC. Based on these remarks in the Order, I wrote to MSEDCL to disconnect electric supply to the 14 shops which have been provided electric connection on the basis of fraudulent documents submitted by the accused. MSEDCL refuses to disconnect the electricity stating that they needs Order from the High Court directing them to disconnect electricity. Please Advise.Bhushan Khatrin9096159191
The proceedings before the magistrate where is the order framing charge is passed, these proceedings or to Try the accused and if found guilty to punish the accused.
The proceedings before the magistrate do not have the bearing on MSEDCL’s electricity supply. In these proceedings Magistrate would not have the jurisdiction to pass Orders of directions to the MSEDCL.
To disconnect the electricity supply, the procedure that is provided in the Electricity Act needs to be followed.
