Not returning borrowed money from me

My friend has taken cash and loan on my name but now not paying emi of it and 50% cash is not yet returned. Pl advise how to get back it legally

Well, you can lodge a Police Complaint against that person who by misrepresenting facts before you, duped you to consent for become ready to act as the Guarantor of Payment of Loan in case of Arrears! Now, as he is not paying the loan, you need to prove, that, he misrepresented facts before you, and that's why, you became a Guarantor and hence you are not legally liable to pay to Bank for Court!

First thing …get all the thing in writing …prepare an affidavit get it signed by accepting the debt taken as friendly loan … and arrange proofs of acceptance of debt if otherwise . Then you can proceed legally in court by filing a recovery suit .

If he has taken a loan without your knowledge or consent, you can file a police complaint for offences such as cheating and forgery. However, if you were aware of the loan and had voluntarily provided your documents, then the appropriate course would be to first send a legal notice, followed by a civil suit for recovery of the amount. In such a case, you will need strong evidence to prove that although the loan was in your name, it was actually taken and used by him.
