10th standard marksheet or school leaving certificate if possible or the last resolution would be an affidavit supported by secondary proofs which could aadhaar, voter id and driving licence. This should be sufficient for them to consider it and move the application
Q: Domestic violence and divorce / alimony
I had a past relationship before marriage and my husband knows about that, but after one year of marriage he is not accepting that past relationship. Because I had some conflict with my inlaws, they removed me from home 3 times and sent my luggage to my home. I filled a complaint against him in women cell, he denied to keep the marriage. My inlaws are having all my jewelery . can I get all my jewelery back and also the alimony from mutual divorce. And if not from much time does contest divorce
Advocate Siddhant Induprakash Rai answered
Yes, you can definitely ask for your jewellery as it is your personal property which was gifted to you during your marriage. They have no right to keep it back. Sending you away from the house and your belongings uninformed also amount to certain level of mental harassment that can also be pleaded, legally. alimony, and maintenance be it by mutual consent or a contested totally depends on the facts of the case.
Q: Nephew of the owner causing problems
There is a nephew of the owner, living since 15 years, he isn't the member of society, not paying rent, yet he has been given to live in the society. He causes a lot of nuisances, this is known even by the owner, but his nuisances cannot be tolerated at all. Can the society and owner legally kick him out on the spot without any legal proceedings?
Advocate Siddhant Induprakash Rai answered
Going by the way your questions are framed, I’d take a wild but professional guess—you’re probably the tenant here, and just trying to figure out how far the society can go . Now, jokes apart, yes, societies do have certain rights to maintain order and discipline, but that doesn’t mean they can bypass legal procedure. If you’re a rightful tenant, they cannot simply throw you out on a whim. There’s a due legal process to be followed, and both the tenant and the society have rights that need to be balanced. The key factor here is whether your tenancy is valid and documented properly. If that part is sorted, you’re in a far stronger position than you think. Let’s just say—if handled right, this can be dealt with smoothly without letting things blow out of proportion.
Q: Asked to move out with immediate effect
If I have a fight with neighbours, and society committee intervenes and finds me guilty (based on their analogy), can they ask me to move out of the flat ON THE SPOT, itself? Or there is any legal process they need to follow?
Advocate Siddhant Induprakash Rai answered
There’s definitely room to defend your position but be careful, because if things aren’t handled properly, you could find yourself on the receiving end of sudden pressure or even legal complications. If you’re a tenant (which it seems you are), the law doesn’t allow anyone to throw you out without following due process. Any removal without proper notice is not only unethical but also violative of your rights. But here’s the thing—once that lock-in period is over, the owner can legally start pushing you out with a notice, and you’ll need to act fast if you want to protect your stay or negotiate better terms. These are the moments where timing and legal framing make all the difference. If you’d like, I can help you figure out the safest and strongest route before it escalates further.
