Not able to pay maintenance under 125 of crpc

I am muslim man who is bound by the court to pay maintenance under sec. 125 of crpc that i was not able to pay and was directed to pay the arrears of maintenance in five equal monthly instalments latest by 19.6.2010. I failed to pay the maintenance resulting in filing of application for issuing warrant of arrest against Me and subsequently, I was sentenced. Even thereafter I failed to make the payment of the maintenance amount due to the respondent (wife and child) herein. The learned Magistrate, Faizabad, vide order dated 4.1.2011 extended the sentence of Tahir under Section 125(3) of the Code for non-payment of arrears of maintenance. This order was assailed by me before Hon’ble High Court of Judicature at Allahabad in Criminal Revision Petition No. 193 of 2011, which upheld the orders of trial court in spite of averments from the petitioner-husband that he had divorced his wife in presence of his brother on 04.01.2011. the revision was disposed.
धारा 125 3 के अंदर आपके आप के खिलाफ जो कार्रवाई विचाराधीन है उसके संबंध में आपने यह नहीं लिखा है कि आपकी पत्नी Jaan Bujh kar aap se आपसे अलग रह रही है या आपने उसे छोड़ो रखा है आपने बिना किसी कारण के अपनी पत्नी को छोड़ रखा है और अगर वह किसी भी तरह से apna Palan poshan kar sakti ho जैसे नौकरी आदि करके तो वह Dhara 125 CrPC की कार्रवाई karne मैं Saksham नहीं Hogi Agar आपकी पत्नी ने आपको छोड़ रखा है तब भी वह भरण पोषण हेतु धारा 125 सीआरपीसी के तहत कोई कारवाई मैं कामयाब नहीं होगी आप इस संबंध में सब सब सबूत जुटाकर संबंधित कोर्ट में प्रस्तुत करें व कोर्ट में अपनी स्थिति स्पष्ट करें कि किन कारणों से मैं भरण पोषण की राशि भुगतान करने में किस प्रकार असमर्थ हूं kannanin पत्नी और बच्चों का पालन पोषण करने का दायित्व आप पर है आप यह दायित्व इस प्रकार पूरा नहीं कर पा रहा है यह आपको साबित करना होगा धन्यवाद
