Need to know about the positive possibilities of the case

My lover is committed a crime of 375(penetrates his penis, to any extent, into the mouth of a woman or makes her to do so) by telling that he will marry me. But I am virgin. If the case is filed against him, this can not be proven by medical examination or there will be no any other proof. But that he have agreed over the phone that he have done something when we were together. Is that recording will become the strongest proof, so that he will get punished. And in the police station, he is telling that he will marry me, only thing I should stop fighting and need the time to know that I stopped fighting. But I don't think so that he will marry me. And in the station, after the enquiry, the inspector said that he will file 493 and also 376. But I feel that, my lover may easily get the bail. And also I want to know, is there any chances that he will prove that he is not guilty. After the enquiry, in the written statement, he have mentioned that, I am his friend only, not a lover.
