Need Lawyer for High Court Appeal in Murder Case

17-Jul-2025 (In Criminal Law)
We had filed a murder case (Section 302 IPC) in the Sessions Court , West Bengal. Unfortunately, the accused was acquitted due to lack of evidence. We strongly believe the judgment was not correct, and we now wish to appeal this decision in the Calcutta High Court.

Yes, you can definitely appeal the acquittal under Section 378(4) CrPC by filing a Leave to Appeal before the Calcutta High Court against the judgment of acquittal in the Sessions Court. Since this is a 302 IPC (murder) case, it is a serious matter and the High Court has power to reappreciate evidence. But the appeal has to be drafted carefully, citing the glaring errors of judgment, ignored evidence, or misinterpretation of law by the Trial Court. A proper legal strategy, with detailed case analysis and scrutiny of the judgment, will strengthen your appeal. I would strongly recommend a case paper review to explore this in depth if you’d like experienced legal representation for drafting and filing the appeal in High Court — it must be done within the limitation period. Let’s ensure your voice is heard and justice is pursued effectively.

Therefore you have to be ready with all the documents and file an criminal revision in High court stating the reasons where there had been errors in chargesheet and the investigation and such could be shown in appeal process and result in the courts views of the case and misrepresentation of the earlier acquittal and presentation of new facts.
