Section 340 of the CrPC (Perjury): If your wife knowingly submitted false evidence or made false statements under oath in the family court (e.g., using closed rehab records to claim current mental illness), you can move an application for the court to initiate an inquiry into perjury. Counter-Claim for Cruelty: In divorce proceedings, proving that your spouse leveled false, scandalous, and baseless allegations (like false addiction or mental illness) can itself be considered a ground for mental cruelty against you

Dear Sir, Civil Defamation Suit Yes a civil suit for defamation is maintainable. To succeed, the client must prove Falsehood The allegation of mental illness or addiction used in the divorce petition is false. Publication The statement was made to a third party the Court and potentially relatives society Damage to Reputation: The allegations have lowered his standing in the eyes of right-thinking members of society. Malice Since the rehab records were already discredited by the Human Rights Commission using them in a subsequent court filing can be argued as a malicious attempt to tarnish his character.

Based on the facts you've described, a civil defamation suit under Section 499 IPC (now under BNS) is maintainable, but with important considerations. The use of rehab medical records in court proceedings to allege mental illness may be protected under the doctrine of absolute privilege — statements made in judicial proceedings generally cannot form the basis of a defamation suit, even if false. However, if your wife made such allegations outside court proceedings (to relatives, employers, society members, etc.), that portion can attract defamation liability. Your strongest position lies in the Human Rights Commission order and the Bangalore DC order in your favor — these directly contradict the mental illness claim and establish that the detention was illegal. You can use these orders offensively in the ongoing divorce and OS proceedings to demolish her credibility and seek costs. On the defamation angle specifically, consult a civil lawyer to assess whether the allegations were made beyond court pleadings. If yes, file for damages under civil defamation along with a criminal complaint under Section 356 BNS (criminal defamation). For the divorce proceedings, file the HRC and DC orders as documentary evidence immediately, and oppose any reliance on the rehab records as illegally obtained
