27-Jun-2023 (In Criminal Law)
My father filed an criminal case 12 years ago now recently we got summon for witness to present in the court. We have missed last two dates to present ourselves in court. My father is now 71 years old and a severe cardiac an diabetic patient and my mother is suffering from cancer. Can we seek two months time to appear before court stating treatment of my mother at Mumbai. Is that possible.

in this situation you can seek for leave of time on medical and old age ground and the court may dispense/postpone your personal attendance and if in the opinion of the court, the examination of witness is necessary then it may issue commission for examination of witness and in this case the witness will not be required to go to court as its examination will be done on commission where the witness reside or any other convenient place and the deposition of witness taken on commission will be submitted in the court by the comission.
