Private Complaint is filed before the magistrate has jurisdiction of the case, instead of filing a complaint before the police, this private complaint is often preferred based on each case and circumstances. without any evidence complaint will not be taken by the magistrate. feel free to contact for any legal advice.

Section 200 (Examination of Complainant): Magistrate examines the complainant and witnesses on oath; substance is recorded, signed, and becomes pre-cognizance evidence. Section 190 (Cognizance): Magistrate takes cognizance (decides to proceed) on receiving a complaint, police report, or other information. Section 156(3) (Police Investigation): Magistrate can order police investigation (FIR) even if a complaint is filed under Section 200, if the matter warrants it.
