My wife has filed a kidnapping case against my sister and brother

My wife has filed a kidnapping case against my sister and brother stating they have kidnapped my child a day before i filed for custody of the child.The police are threatening that they give undertaking to produce the child and also when child is produced they will send the child to remand home. Can they do this when custody case is pending and child is with me.Please advise
When the case is before the court you should not have ventured to take the child into your custody without nod of the court. You ought to have applied for custody and interlocutory application to that effect.

The complaint filed by your wife against your sister and brother has got little week grounds since you are also a natural guardian & custodian of the child, your opinion should also taken in consideration by the police. The Police cannot send your child to the remand home when the natural guardian is taking care of the child with utmost importance.
