My two wheeler has been seized by locals and I need to recover it.

22-Jun-2024 (In Criminal Law)
I gave my two-wheeler to an acquaintance to use for his work in a remote place in Assam, on a verbal contract. However, he has run away from the premises after doing some questionable things that have left the local people enraged at him. They have seized the scooter and are threatening to sell it to get their money back. However, the scooter belongs to me and I am not related to any parties in the dispute. All I want is my scooter back to me.

In this situation, you should take the following steps to reclaim your scooter: 1. **File a Police Complaint**: Report the incident to the local police station where the scooter was seized. Provide details of the ownership of the scooter and explain the circumstances under which it was taken without your consent. 2. **Prove Ownership**: Gather any documents or evidence that prove you are the rightful owner of the scooter. This could include the registration papers, insurance documents, purchase receipts, or any other relevant paperwork. 3. **Negotiate with the Local People**: If possible, try to negotiate directly with the local people who seized the scooter. Explain your ownership and provide evidence if necessary. Be calm and diplomatic in your approach. 4. **Seek Legal Assistance**: If negotiations fail and the local people refuse to return the scooter, seek legal advice and assistance from a lawyer who specializes in property or civil law. They can guide you on the legal steps to take to recover your property. 5. **Follow Legal Procedures**: Depending on the advice of your lawyer or the police, you may need to initiate legal proceedings to recover your scooter. This could involve filing a case in the appropriate court or following specific legal procedures as per the laws of Assam. It's crucial to act promptly and follow the legal procedures diligently to ensure the safe return of your scooter.
