My sister in law showed blue movie to my girl

10-Jul-2023 (In Criminal Law)
My sister in law showed pornographic material to my underage girl. She also twice touched her inappropriately and attempted to masturbate in front of her. Since then my child has been quiet and just shared this with me two days ago. The incident happened when she went to live there last year (Nasik). My brother and sister in law are both happily married, but I don't care about that. My child's grades have fallen too. She hasn't been herself ever since she came back from the trip last year. I live in Delhi. Should I file a complain in my PS. Would my child be called for statements and interrogations as she is still going to school and I don't want her or her studies to suffer, She is in the tenth class. What can we expect? Would my sister in law go to jail straightaway? I want her to be accountable to what she has done with my child.

What your sister-in-law did is totally wrong and beyond imagination. You should immediately approach the police/court to register a FIR against such persons. It’s a grave criminal offence and comes under POSCO and under which your sister-in-law can also be jailed. For more legal assistance I am just a call away.

The POSCO Act criminalises a range of acts including child rape, sexual assault, sexual harassment, and pornography involving a child (under 18 years of age. Section 19(1) of the POSCO Act makes it compulsory to report the offence. For the non-penetrative sexual assault committed by a person with sexual intent must be punished with not less than three years and extended up to 5 years of imprisonment under section 10 of the POSCO Act. Since the act was committed by a person of trust your SIL could go to jail for maximum 7 years minimum 5 years. Your child need not go to police Station but her statement would be recorded in her home or her favorite place only by a female police officer

you can file a complaint against her under posco law.... assuming that your child was minor when the so called act took place... plus she can be booked under various Penal provisions of Indian penal code also.... your child will not be bothered much by court and police as these are sensitive matters while recording her statements as per law
