24-Jun-2026 (In Criminal Law)
My friend stolen gold and sold it. Amount is kept in bank account. admited it as well. Now another party put allegation that my friend stolen more then what she did in actually. Is she able to get bail in that case. She is not medically fit as well. Single mother no one else is working in her house. She is poor and she admited that she did this due to financial crises.

Merely because the accused has admitted the offence does not mean that bail will necessarily be refused. The Court considers the nature and gravity of the offence, the evidence on record, recovery of the stolen property, the possibility of tampering with evidence or influencing witnesses, and the accused's medical condition and personal circumstances. If the complainant alleges theft of a higher quantity of gold than what was actually stolen, the prosecution is required to prove such allegation with cogent evidence during investigation or trial. The accused is entitled to apply for regular bail, and the Court will decide the application on the merits of the case.

Bail depends on the exact offences, value involved, recovery of property, and case facts. Being a woman, single mother, medically unfit, and cooperating with the investigation may support a bail plea. If the complainant exaggerates the amount stolen, that can be contested with evidence. She should engage a criminal lawyer immediately and seek anticipatory or regular bail as applicable.

Yes, she can apply for regular or anticipatory bail (as applicable), but grant of bail depends on the nature of the offence, value of the alleged stolen property, stage of investigation, recovery, criminal antecedents and the likelihood of tampering with evidence. Merely because the complainant alleges a higher amount than what was actually stolen does not automatically disentitle her from bail. The prosecution must substantiate its allegations with evidence. Her medical condition, being a single mother, absence of previous criminal record, cooperation with the investigation and recovery of the stolen property or sale proceeds are relevant factors that the court may consider while deciding the bail application. She should immediately engage a lawyer and place all mitigating circumstances and supporting medical documents before the court.

According to general exception under Section 480 of BNSS the court has a special statutory discretion to grant bail to women, a child or a sick person. As your friend is unwell you can file Interim Bail on medical grounds.
