Sir, I paid money for buying plot in installment in Chennai. After completing full payment, real estate company is not giving me the land registered and also that particular plot is sold to some other buyer. The company’s failure to execute the sale deed after collecting full payment amounts to cheating and criminal breach of trust under IPC. You can file a police complaint with the Economic Offences Wing and also seek civil remedies. A civil suit for specific performance can be filed to compel the builder to register the property in your name, or alternatively, for refund of the entire consideration with interest and damages. Preserve all receipts, agreements, and communications as they will serve as key evidence in both proceedings.

Dear Client, 1. Yes. You can file a criminal case for cheating and fraud under IPC against the real estate company. 2. Also, file a consumer complaint before the District Consumer Commission (Tamil Nadu) to recover your money with interest or get an alternative plot. Keep all payment proofs and agreements as evidence. 3. Consult an advocate to discuss your case in brief. 4. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore

You can file a criminal complaint for cheating, breach of trust, and fraud under Sections 406 (BNS316) and 420 (BNS318) of the IPC against the real estate company at the jurisdictional police station. Simultaneously, you can file a civil suit before the Consumer Commission or Civil Court seeking refund of the entire amount with interest and compensation, or direction to register an alternative plot as agreed. You may also seek an interim injunction to prevent further sale of nearby plots until your matter is resolved.
