Mis use of government school funds

My principal mis used 40 lakhs government fund of my school and repayed back with savings bank interest after 5 years. We came to know now that he indulged in fraud.
But his lawyer saying that though he mis used for himself he paid back with interest ,so there won't be a strong case of 420 and 406 .Is it correct according to law.we got all proofs against him as well as his self acceptance of embezzling funds
you are saying he is accepting his crime, then he is the accused and accepting crime means he has to face consequences , fine or imprisonment for misusing govt money and cheating govt, you can contact me I will clarify and we can file a writ petition in highcourt also against the person
