On the basis of the facts shared, it is evident that you and your mother are facing continuous mental and physical harassment, along with life threats from your father. Such acts amount to domestic violence and criminal intimidation under law. You have the right to seek protection and relief under the Protection of Women from Domestic Violence Act, 2005, by filing a complaint before the Protection Officer or Magistrate. Immediate police protection can also be sought by dialing 112 or approaching the nearest police station. You may also lodge an FIR for threats or assault under relevant Act. The court can grant protection orders, residence rights, and maintenance for safety and welfare. It is advisable to collect evidence like messages, audio recordings, or witness statements to support your case.

The primary remedy is to file a case under the Protection of Women from Domestic Violence Act, 2005 before the Magistrate Court of your area through a lawyer . In this case you and your mother can seek multiple reliefs such as Protection Order (to restrain him from threatening or harming you), Residence Order (right to stay peacefully in the shared household), Monetary Relief for medical and living expenses, and Compensation for mental trauma and emotional distress. The court can also direct counselling or other suitable measures for your safety.

What you and your mother are facing amounts to serious domestic violence and criminal intimidation under Indian law. Mental harassment, physical abuse, daily threats to kill, and verbal cruelty are all punishable offences and should not be tolerated any further. Since you are 21 years old, you can independently approach the police along with your mother and lodge a detailed complaint narrating the full history of abuse, threats, and assaults. The police can register FIR for offences such as assault, criminal intimidation, cruelty, and intentional mental harassment. If there is immediate danger, you can also call the women’s helpline or emergency number for protection. Your mother can file a case under the Protection of Women from Domestic Violence Act in the local Magistrate Court. Through this, she can seek a protection order restraining your father from abusing or threatening her, a residence order to secure peaceful living in the house, monetary relief/maintenance if required, and compensation for mental trauma. You can also be a supporting witness in this case since you have directly seen and suffered the abuse. If physical violence has occurred, it is important to preserve any medical records, photos of injuries, threatening messages, call recordings, or any other proof. Even if you do not have proof for everything, your statement itself is enough to start legal action, and investigation will follow. For your own mental health, it is also advisable to seek medical or counselling support, especially since you are experiencing panic attacks. Medical records will also strengthen your case legally by showing the impact of prolonged abuse. If you do not have money for a lawyer, both you and your mother are entitled to free legal aid. You can go to the District Legal Services Authority at your nearest court complex and request assistance. They will appoint a lawyer at no cost. In short, the best course is to immediately report the abuse to the police, initiate a domestic violence case for long-term protection, collect whatever evidence you can, and seek free legal aid if needed. The law is on your side and provides strong protection against such cruelty, even when the abuser is a parent or family member.
