Materials not supplied by supplier

On business discussion, I paid part amount to one my party in jamnagar, Gujarat to supply materials.. But till date he has not supplied and now not receiving the calls too.. Would like to file criminal case against him.
you can file complaint with the police under section 420 of the Indian Penal Code I can also suit recovery of money paid along with damages . I can only give proper advice some more information is supplied to me . kindly contact me with more information

If you want to obtain the materials you cannot file criminal case. You would have to file civil suit for breach of contract and seeking specific performance of contract with compensatory damages as an alternative remedy.
However a criminal case for misappropriation of property and or cheating is also maintainable, though it would not solve any problem.
