Mal practices of doctors..criminal offences punishable under IPC

I have lodged police complaint against four culprit doctors who r from open category but converted into Nav.Budhha and alloted seats for m.b.b.s under scheduled caste.Medical college is hesitant to provide documentary evidence requested under RTI. But I recd list of students of that college who appeared,passed and failed in 1st m.b.b.s. Exam with marking by college staff with their hand showing castes of students to present before DEAN,provided by college through social welfare dept govt of Maharashtra. Whether this authenticated list can be treated as documentary evidence for legal action ?

Though it cannot be treated as primary evidence you can utilize it as a secondary evidence as you are not provided with requisite details under RTI. Further you file appeal under RTI for non issuance of the details as mentioned by you.

Yes, you may be able to use the same citing reluctance of college to provide information under RTI. Plus, you can file appeal under RTI if college is refusing to provide the information. Court can also direct college to provide information based on your submission.
