Lockdown Violation - Kolkata_May 2021

31-May-2023 (In Criminal Law)
As you must be aware there is a lockdown in west bengal. 4 wheelers are not allowed on road without proper reason. Yesterday, I went to visit my elderly parents for delivering groceries & medicine in my car. While returning (at around 9.45 AM) I was stopped by police. I explained to them that the reason i took my car was to deliver the grocery and medicine to my parents but they still asked me for car documents. Then they filled up few forms and asked me to sign. They didnt give me any receipt. One of the policeman then asked to transfer 350 to a gpay account. I was told i will receive a call from the court and then I have to go to court and plead guilty. I am worried that it will go to my personal record and impact my future visa and job application. Will be really helpful if you can help me understand how to handle this situation so that my personal record is not impacted. Also what are the chances of actually getting the summon from court.

As per government guidelines if you dont abide with the circular issued on public interest then you are committing an illegal act. In this case whether you were going to deliver food and medicine to your parents that is a chapter of argument which needs to be proved in court however to get a court notice on violating government circular can lead to a summon subjected to the case registered by the police. It is also true that if a police case is registered against you then getting a visa will not be possible till the case is either dismissed or settled. There are different legal paths to come out from this.

Hello although I'm not yet privy to all the legal action initiated against you but it appears to be a case of fine imposition. in such cases the record are not tarnished and there would be no implication on either your job or visa prospect. nevertheless if you still want to pursue the case to its logical conclusion and want to keep your record unblemish then you may contact me and I will see through it. remember my pro bono services are only limited to the poor.
