Legal remedies for fraud committed by cashier

sir, there was a cashier in our office who collects amount against proper receipts issued to members. That cashier issued proper receipts and took cash but misrepresent amount in cash book, hence done fraud AND FORGERY, CRIMINAL BREACH OF TRUST etc. . what are the remedies available to us, if we file criminal compliant then can we recover the amount standing on his part.

There are two ways criminal complaint is not for recovery but to punish the accused for the offences committed. For that FIR Hasbro be registered. If police does not register FIR u have to file application under section 156(3) of cr.p.c. for recovery of money you have to file civil suit.

You may first file a complainant to the police station upon which the police shall register an FIR on the basis of you complaint. In case Police refused to register an FIR you may approach the concern Court by filing complaint case. If you initiate a criminal complaint against the accused and the case is proceeded then you may have change of getting your money back.

If the employee was working on formal basis under a contract of employment you may additionally file a suit for damages and recovery of amount.
Both cases may run concurrently.

yes you can file the complaint against the cashier under the appropriate leagl provision with all the documentary proof supported the allegation before the jurisidictional magistrate and get it admitted
