Legal Advice Required Regarding Car Booking Delay and Misleading Commu

20-May-2026 (In Criminal Law)
I booked a car by paying the booking amount, but the dealership is continuously changing delivery timelines and giving contradictory communication through emails and customer support. There is no clear confirmation regarding delivery despite taking payment from me. I would like to know: Whether this amounts to deficiency in service or unfair trade practice under Indian consumer law. Whether I can send a legal notice to the dealer/company.

1. Deficiency in Service Once the dealer accepts your booking amount, a service obligation arises—this includes transparent communication, reasonable adherence to timelines, and fair dealing. Continuous delay without clarity and contradictory responses is a classic case of deficiency. Courts have consistently held that even pre-delivery conduct (like booking and allotment) falls within service. 2. Unfair Trade Practice If at the time of booking they: represented an earlier delivery timeline, or induced you to pay without disclosing actual waiting periods, then it may amount to misleading representation—hence an unfair trade practice. We can send legal notice to them: if you want I can draft it for you...

yes definitely in your case you can send a notice to the dealer for timely giving you a new product car and even after the notice is served and you do not get the product then you can definitely file a case in the consumer court

Yes, the dealer's constant delays and contradictory communication definitely amount to Deficiency in Service and Unfair Trade Practice under the Consumer Protection Act, 2019. Send a Legal Notice: You can and should immediately send a formal legal notice to both the dealer and the manufacturer demanding immediate delivery or a full refund with interest. Consumer Court: If they do not comply, you can file a case in the Consumer Forum for a refund, interest, and compensation for mental harassment.
