Legal Advice Regarding Downloading and Processing Fictional Anime Cont

16-Jul-2025 (In Criminal Law)
I am a student and would like legal advice regarding a concern. A while ago, I downloaded an anime-style image from a public website (like DeviantArt). The character was a fictional high school girl. Out of curiosity, I uploaded the image to an AI tool to create a realistic version. I did not share or publish the image anywhere. After learning that such content might be illegal under Indian laws (like POCSO or IT Act 67B), I immediately deleted everything from my device and accounts.

On prima Facie there's no clarity as to what's the nature of the image you are talking about. As to deleting the image if the image falls under pocso offence then download itself is going to be sufficient to convict you. It's advisable to contact me and provide more details to assist you better.

Based on your description, no criminal intent or distribution appears involved. Since the image was fictional, not real, and was never shared or circulated, and you've already deleted all copies upon realizing the legal sensitivity, prosecution is unlikely. However, Section 67B of the IT Act and POCSO are strict, even regarding fictional depictions. I advise avoiding similar content or tools in the future. If you're ever questioned, legal support can clarify your intent and actions.
