last year FIR was lodged against me by my mother and she is ready to withdraw it but now she is in brampton Canada, and refusing to come to India and there are many ways to withdraw like affidavit, video conferencing and discharge application but judge of karelibaug area in district and session court is refusing to grant, he wants to call my mother and she is not coming and this very difficult case and judge just want to give date and don't want to work on case. so is there any other way to withdraw FIR excluding district judge because he will just give dates and not give judgment.

bring other witnesses on record and tell them to hostile or option is to file 482 crpc quasi petition at high court with your mother affidavit and request to high court, the high court will listen your prayer.

You can directly move a petition before the Hon'ble High court and get the FIR quashed on that ground. Open to further queries. Regards, M. K. Vohra & Associates, Advocate & Trademark Attorney. Ahmedabad, Gujarat.
