Landlord Absconded with 6 Lakh Lease Deposit
18-Nov-2024 (In Criminal Law)
Hi everyone,
I’m seeking advice regarding a lease deposit issue. In Sep 2023, I paid ₹6L to my landlord, under an 11-month agreement. Since July 2024, he’s refused to return it, giving false promises. The house is under NPA, with loans taken fraudulently. Despite complaints to police (Sep 17) and SP office (Oct 10), no action has been taken. Police claim it's civil, not criminal, despite his threats. My family faces financial and mental stress. What are my legal options?
Well definitely you can file a criminal case against the landlord, as he had deliberately deceived you and the bank, and failed to return your lease amount. And it is now evident that he had wantonly conspired against you, by bringing you in for lease on his property. And as it was declared as Non Performing Asset, the bank would go proceed further in garnishing the property so that it can sell it through auction.
Better using the complaints that you have filed with the police and sp office, try to file a FIR direction/ Private Complaint before the Judicial Magistrate Court based on your jurisdiction
