It's a false case. Police submitted chargesheet at sub divisional court. Barrackpore. Complainant went to RG KAR hospital to make a medical certificate on rape case but refused medical test. So medical was not done for her refusal. No witness was there because nothing happened. The case was regarding her car parking in front of someone's garage. Now how much merit belong to this false case? Please explain

rape is a cognizable offense and upon complaint filed by a woman police has to register an FIR also to file chargsheet upon investigation. here the whole thing matters that the story/facts of the complaint which is subject of trail. if you think that a false case has been registered against you then you can file and quashing proceding before high court. But at first you have to take Bail from the competent court if FIR is registered against you.

meet a criminal lawyer from our high court who will assess the merit of your case and can suggest you to get the case quashed if sufficient grounds are made out. in fact from all that you have said it seems to be a good case for quashing.
