Madam, Yes, even after a gap of 4–5 years, a criminal complaint can still be filed in certain circumstances, especially when you now have supporting evidence. In cases relating to criminal intimidation, harassment, mental cruelty, blackmail, or threats, the police as well as the Court may consider the nature and seriousness of the allegations along with the reason for delay in filing the complaint. The delay does not automatically bar your case if you can properly explain why the complaint could not be lodged earlier and if the evidence now available supports your version. Preserve all available proof such as messages, call recordings, screenshots, witnesses, medical records, or any other relevant material. It is advisable to immediately consult a local criminal advocate with all documents and evidence so that the matter can be examined properly and appropriate legal action can be initiated without further delay. Hello Ms. Sowmya, Yes, it may still be possible to initiate legal proceedings even after several years, depending upon the nature of the offence, the evidence presently available, and the reasons for the delay in approaching the authorities. In cases involving criminal intimidation, threats, harassment, extortion, blackmail, or similar offences, the police and courts can consider the complaint even after a lapse of time if sufficient evidence is now available and the delay can be reasonably explained. However, a proper legal opinion can be given only after examining the complete facts, the evidence in your possession, and the exact nature of the incident that occurred in 2021. Please share the brief facts of the case and the available evidence so that I can advise you regarding the appropriate legal remedy and the maintainability of the complaint.

Yes, your sister may still be able to take legal action even though the incident occurred in 2021. The delay in filing a complaint does not automatically prevent a case from being registered, especially if relevant evidence has only recently become available. She should submit a detailed written complaint to the police explaining the incidents, the nature of the threats or harassment, and the reason for the delay, along with all supporting evidence now in her possession. The authorities will assess the allegations and evidence to determine the appropriate course of action. If the police do not take action, she may approach the jurisdictional Magistrate for suitable directions. Before that I need to examine the facts and evidence and guide you on the most effective legal remedy available.
