Q: Need Legal Help to Recover Money from Fraudulent Agent

I am from Hyderabad. An agent from Rajasthan promised to send me to Dubai on a work visa with a job within 3 months. Based on his promise, I paid him a large amount. I trusted him because a neighbor of his father had successfully gone to Saudi Arabia through him. Later, he told me to come on a visit visa and assured me it would be converted to a work visa within a week. After I reached Dubai, the local contact he gave me confirmed that no work permit had been applied for and that the agent had lied. He is now ignoring me and refusing to refund my money. I have WhatsApp chats, call recordings, payment proof, and other evidence. I filed a Cyber Crime complaint. When police contacted him, he falsely claimed I paid an agency, not him. However, he instructed me to transfer the money to that account, which is in his name. What legal action can I take to recover my money? Can any lawyer help me?

Based on the facts, this appears to be a case of cheating and criminal breach of trust, along with possible offences relating to fraudulent overseas employment. Since you have WhatsApp chats, call recordings, payment proof, and other evidence, continue pursuing the Cyber Crime complaint and, if necessary, seek registration of an FIR before the jurisdictional police or through the Magistrate. You may also initiate a civil suit for recovery of the money and issue a legal notice demanding a refund. The agent's claim that the money was paid to an agency is weak if the transfer was made to an account under his control on his instructions and the evidence supports that. A lawyer can assist in both the criminal proceedings and the recovery action.

A neighbour has sent a legal notice stating we caused a mental trauma to him bcz of messages in wtsapp group. He cited we have to tarnished his image and spoiled his reputation. If it was frozen by the police, we can apply to the Investigating Officer or file a petition before the jurisdictional Magistrate for de-freezing. If it was frozen by a court, we must approach the same court. Once de-frozen, you can use the account for your employment purposes.

Hi, I am the complainant. Last month, a case was registered against my boyfriend under Section 69 of BNS, and he is currently in custody. Now, we both want to settle the matter mutually, and I want to withdraw the case. Since Section 69 BNS is non-compoundable, what is the fastest procedure to get him regular bail? Can I file a 'No Objection' affidavit in the lower court to help him get bail quickly, or do we have to approach the High Court to quash the FIR? Please advise on the next steps

Section 69 BNS is generally treated as a non-compoundable offence. Therefore, the complainant cannot simply withdraw the case before the trial court, nor will a No Objection affidavit by itself result in automatic closure of the case.For bail: The accused can file a regular bail application before the competent court. The complainant may file an affidavit or appear before the court stating that the dispute has been amicably settled and that she has no objection to grant of bail. While not binding on the court, such a statement may be considered as a relevant circumstance while deciding the bail application.For closure of proceedings: Since the offence is non-compoundable, the parties may approach the High Court under Section 528 BNSS inherent power seeking quashing of the FIR or criminal proceedings based on settlement. The High Court will examine the facts and nature of allegations before passing appropriate orders.Therefore, the immediate remedy for release from custody is to pursue regular bail before the competent court, and thereafter, if legally permissible, seek quashing of the proceedings before the High Court on the basis of settlement.
