Is hiring escorts without the involvement of a third party legal in India? Is escort service legal i

17-Jul-2024 (In Criminal Law)
Hi, I want to know if hiring an individual independent escort without the involvement of any third party is legal in India. If not, then how are there so many independent escort websites? They claim it is legal to hire individual escorts. Is escort legal in India? Is escort service legal in India? Please shed some light on the legality of Indian escort services. Thanks a lot.

In India, escort services operate in a legal grey area. While prostitution (sex work) itself is not illegal, many activities related to it are punishable under various laws.

Advertisements for escort agencies often carefully skirt the legal line, and avoid specifically offering prostitution or sexual services. This fact in turn is well-known to police and the political powers, who, where prostitution is illegal, usually prefer to act against more visible and problematic street prostitution. There are however, agencies that do go by these laws and
do not facilitate prostitution.
Occasionally local law enforcement will do stings with escort agencies, but the exchange of sex for money is often hard to prove.
...so yes it is 'Legal'.

In this sense Prostitution in India is legal, but a number of related activities, including owning or managing a brothel, pimping and pandering are crimes.

Prostitution itself is not illegal in India, but many related activities are punishable under the Immoral Traffic (Prevention) Act, 1956—such as running a brothel, soliciting in public, pimping, or trafficking. Hiring an independent escort who works voluntarily and without third-party involvement in a private setting is not explicitly prohibited, but it falls into a legal grey area. That’s why many escort websites claim legality, often advertising services as “companionship” to avoid legal trouble. However, engaging in or availing such services may still attract legal scrutiny depending on the situation, so caution is strongly advised.
